Shave Club™ MEMBERSHIP AGREEMENT AND DISCLAIMER
Read This Membership Agreement Before Placing Your Order
and Becoming a Member Of the Can Shave Club™ (www.canshave.com).
1. INTRODUCTION. This Service Agreement is entered into
between Can Shave Club™, its successors and assigns, hereinafter,
"Can Shave Club™" and you, the member, hereinafter,
"Member", the service of providing the Member
with shaving products, which include razors, creams and
accessories, hereinafter is the, "Shaving Products"
. Can Shave Club™ is a unique online shaving club, which
provides members with high quality "Shaving Products".
2. MEMBER'S ACCOUNT. Upon joining as a member, the Member
will be able to order high quality "Shaving Products"
that will be shipped out to the members address. Any unauthorized
use of the Can Shave Club™ will be grounds for termination
of this Agreement by Can Shave Club™ and or cancellation
of a Members membership.
3. TERM OF AGREEMENT. Continued use of our services constitutes
acceptance of this agreement, our shaving products and any
future versions. Both parties hereto will be acting in an
individual capacity and not as agents, employees, partners,
joint ventures, or associates of one another.
4. PERFORMANCE. Can Shave Club™ shall be deemed to have
performed its obligations under this Agreement upon providing
the Member the Shaving Products they ordered. However, Can
Shave Club™ reserves the right to refuse service to any
member for any reason it deems appropriate. Can Shave Club™
guarantees products for a period of 30 days from the time
they arrive at the members address, see guarantee details
below. Should any provision of this Agreement be found invalid,
ineffective or unenforceable under present or future laws,
the remainder of the provisions shall remain in full force
and effect and shall in no way be affected, impaired or
invalidated. No waiver of breach of any provision of this
Agreement shall constitute a waiver of any other breach,
or of such provision. Failure of Can Shave Club™ to enforce
at any time any provision of this Agreement shall not be
construed as a waiver thereof. The remedies reserved by
Can Shave Club™ under this Agreement shall be cumulative
and additional to any other remedies in law or equity.
5. SUBSCRIPTION REQUIREMENTS. You, the Member, by registering
for our Shaving Products, hereby affirm that you are of
legal adult age as deemed by the governing authorities of
the client's country of origin.
6. PAYMENT. We currently accept payment for a Can Shave
Club™ products by credit card only. We do not accept payments
by mail at this time.
7. WEB SITE AND SERVICE USAGE. Can Shave Club™ products
are only meant for use by individuals seeking consumer shaving
products. Can Shave Club will have been deemed to have fulfilled
it's obligations to a member in terms of order fulfillment
by providing the the Member with the Shaving Products ordered
by the member. These shaving products will arrive in the
mail to the members address provided at the time of checkout.
Checkout being completed on paypal. Members are not at the
time signing up for a subscription. Should a member wish
to have a subscription they can contact Can Shave Club.
If a member requires more products they will need to reorder
at Canshave.com. Purchases at this time are "one time
only". You will not be rebilled. Any
member found using the our service for any other use, commercial
or otherwise, without our express given consent will have
their account access deleted. Members hereby agree that
Can Shave Club™ and its employees, agents, affiliates, partners,
advertisers, or assigns are not liable for any costs of
damages arising directly or indirectly from the use of the
Shaving Products, including any indirect, incidental, physical,
exemplary, multiple, special, punitive, liquidated, or consequential
damages. The shaving products sold contain extremely sharp
razor blades and have the ability to cut skin if used wrong.
Members should never attempt to tamper with or manipulate
blades. Beards need to be trimmed short with an electric
trimmer before attempting to use one of our Shaving products.
Although these types of safety razors can generally shave
beards, a trimmer maybe needed as well, otherwise it could
be difficult. Razor burnt, cuts, nics, scratches, and skin
irritation can be caused when using a safety razor such
as these sold on CanShave, members are hereby aware of this
and Can Shave Club™ cannot be held liable in anyway for
any consequences that may result from using these products.
If a member has never used a safety razor it's recommended
that they not use Canshave, razors sold on Canshave are
meant for adults who have already used safety razors in
the past and are familiar with how they work. Shave creams,
aftershave, and other lotions may also potentially cause
skin irritation or an alertic reaction with some people
and or sensative skin, members are hereby aware of this
and Can Shave Club™ cannot be held liable in anyway for
any consequences that may result from using these products.
When using any lotion, creams, or aftershave products they
should be first tested by members by rubbing a small amount
on the back of the hand and waiting 30 minutes to see if
any type of sever reaction happens. If this is to happen
the product should not be used. If this doesn't happen then
a small amount could be applied to a very small area of
the face just to test it. Then if there's not any issues
they could be used in the normally directed manor as instructed
on the packaging. If a member experiences any problems with
any of the shaving products they need to contact Canshave
immediately by visiting the contact page of this site (www.canshave.com/contact.htm).
Members agree to hold Can Shave Club™ harmless for any resulting
damages either physical or otherwise from using the products
sold on the CanShave Club website (canshave.com). Any information
shared on this website in the form of reviews, or any information
shared on any other websites providing reviews or feedback
on the Canshave club products is only someone's opinion
based on their experience, and should not be relied upon
as an absolutely guarantee that every member will have the
same experience when using any of the products sold on the
Can Shave Club. Products sold on the Can Shave Club are
popular brand name high quality 3rd party merchandise, we
do not manufacture our own products. Shipping is free but
in some situations can potentially take up to 8 weeks. Generally
products will arrive in under 2 weeks. Generally we providing
shipment tracking and we will be able to track any packages
in case of any delays. Regarding the "Free Blades for
Life" offer available at: http://canshave.com/freerazorblades.htm
; this is a referal program offered at Canshave. It works
like this: Step 1) a member orders some products for themselves,
Step 2) A member then has the option to refer some friends
to the Can Shave Club. Step 3) We will then contact these
referals and let them know about our website, if at least
3 of them join as a members, we will track back those referals
to the member as the one who refered them. When this happens
the Member qualifies to get free blades. As long as the
member has referred at least 3 paid members they qualify
for free blades. We will let you know by email when at least
3 people refered have joined, letting you the member know
that we will be sending you more free blades. The free blades
that are shipped out will be just the razor carterages,
or blades that attach to the end of the handle. The blades
will be the same type that fit the handle you purchased
orginially. We will send you a package of 4 Cartridges.
Each time at least 3 referred members order you will get
free blades. If you do require more blades let us know or
else you can order more on our site. We maybe revising this
within a few months which will be a subscription service,
and that will allow you to get free blades sent automatically
to you every six months. If that should occur we will contact
you by email to let you know of such changes. If your referals
also join on a subscription basis then you the refering
member will get free blades shipped to you every six months.
Members agree and understand that typically safety razors
such as you see sold on CanShave Club need to be used along
with some form of shave cream. Shaving without the use of
shave cream could results in cuts and or skin irritation
and is not recommened. Proper care and maintenance of these
shaving products is important. If a blade gets rusty, dull,
bent, cloggs with hair, runs out of lubricating strip, or
any other issue appears with the razor, then the member
should not use it and should change the blade. Blades should
be changed at least ever week to avoid shaving with a dull
blade and members are responsible for changing their blades
and are aware that they need to be changed. This involved
depressing a button on the handle, which ejects the old
blade and then pressing the handle into a new unused blade
which attaches it to the handle for use. Complete instructions
are provided with the packaging and these need to be carefully
read and followed by the member for proper product usage.

8. TERMINATION. Either party may terminate this Agreement
at any time and for any reason. A Member must provide notice
of intent to terminate their membership to Can Shave Club™
by text message or by email. Without prior notice, Can Shave
Club™ may terminate this Agreement, a Members account, for
any reason, including, without limitation, if Can Shave
Club™, in its sole discretion, believes a Members has violated
this Agreement, our Acceptable Use Policy, or any of the
applicable user policies. Can Shave Club™ may terminate
your account without notice. (this is very rare and only
in the most extreme of situations).
9. REMEDIES. If you are dissatisfied with being a member
of Can Shave Club™ or any of our Shaving products, related
terms, conditions, rules, policies, guidelines, or practices
of Can Shave Club™, your sole and exclusive remedy is to
discontinue using the website and the products sold on Can
Shave Club. Refunds are only given for 30 days from the
date the product is received by the member. After the first
30 days time frame that a member has to excersie the refund
policy, we do not provide refunds. Should a member decide
to excerise the refund they may do so by email stating simply
their name, email address, and any other relavent contact
information and that they wish to request a refund. We will
generally get back to you on refund matters within 24 hours
by email to resolve your problem. If no resolution can be
made, then the members sole remedy is to ship the product
back to our company a the Members expense. The complete
order must be shipped back included any used product. Upon
receiving back the used products and inspection of the returned
merchandise Members will be provided a refund on PayPal.
Members hereby allow up to 7 days to have your refund processed
and refunded by canshave from the time the returned product
is received at our warehouse. Typically refunds are processed
immediately. Should any disputes arise with respect to this
Agreement, both parties agree to act immediately to resolve
any such disputes. Time is of the essence in the resolution
of disputes. Upon agreement by the parties, any disputes
may be resolved through arbitration. The decision of the
arbitrator shall be binding upon both parties. Sections
3, 5, 7, and 11 of this Agreement shall survive termination.
10. DISCLAIMER. Can Shave Club™ is a unique online website
selling Shaving Products. Can Shave Club™ makes no express
warranties or guarantees and waives all implied guarantees,
including, but not limited to the guarantees at our website.
By becoming a member of Can Shave Club™, you hereby agree
to have read and accepted the terms and conditions on this
page. To read this page again in future you should bookmark
this page for future reference. If you do not understand
any part of this agreement please contact us for clarification
before placing your order. Members agree that if they are
purchasing product as a gift or on behalf of some other
person that they make the other person aware that they are
bound by the terms contained in this user agreement.
11. JURISDICTION. This agreement is governed by the state
and has jurisdiction over all disputes arising out of or
related to this Agreement and the Services. You consent
to the personal jurisdiction of such courts sitting in the
country of Sweden with respect to such matters or otherwise
between you and Can Shave Club™, and you waive your rights
to removal or consent to removal.
12. MISCELLANEOUS. Can Shave Club™ may revise, amend, or
modify this Agreement and any other user policies and agreements
at any time and in any manner. Can Shave Club™ may assign
this agreement, website, members data and information to
its successors or to any other organization without notice
to the Member. By becoming a Member, you hereby agree to
have read and accepted the terms and conditions listed in
this agreement. The information contained on this page is
legally binding between you the Member and Can Shave Club™
until or if such a time as one or both decide to terminate
the said agreement. If you agree with all the statements
contained herein please proceed to place your order and
become a member upon which you will be bound by these terms
in this legally binding agreement, however, if you do not
agree with all these terms and conditions then please email
us before becoming a member.
